§ 1 Validity

1.1 These General Terms and Conditions (GTC) apply to all orders placed via our online store at www.thefinisher.com by consumers within the meaning of Section 13 of the German Civil Code (BGB). This online store is not aimed at entrepreneurs within the meaning of § 14 BGB.

1.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside his trade, business or profession. An entrepreneur is a natural or legal person (or a partnership with legal capacity) who, when concluding a legal transaction, is acting in the exercise of their commercial or independent professional activity.

§ 2 Contractual partners, conclusion of contract, correction options

2.1 The customer's contractual partner is Koch-Chemie GmbH, Einsteinstraße 42, 59423 Unna, Germany. The purchase contract is concluded with the latter.

2.2 The presentation of the products in our online store does not constitute a legally binding offer, but a non-binding online catalog.

2.3 Placing the goods in the shopping cart is non-binding. Only when you click on the "Place binding order" button do you submit a binding offer for the goods in the shopping cart. The entries can be corrected at any time before sending the binding order. To do this, you can use the usual correction aids provided and explained in the order process.

2.4 Confirmation of receipt of your order will be sent by e-mail immediately after the order has been sent. This does not constitute acceptance of your offer.

2.5 We will accept your offer within two working days by sending you a declaration of acceptance (order confirmation) in a separate e-mail or, if applicable, the payment transaction will be carried out by our service provider or the selected payment service provider, whichever happens first. The time at which the payment transaction is carried out depends on the payment method you have selected (see section 5.3).

§ 3 Contract language, contract text storage

3.1 The following languages are available for the conclusion of the contract: German, English, Spanish and French

3.2 We save the text of the contract and send you the order data and our GTC applicable at the time of conclusion of the contract by e-mail in text form.

3.3 For security reasons, the text of the contract is no longer accessible via the Internet.

§ 4 Shipping and shipping costs

4.1 We deliver the goods to the address specified by you in the ordering process. This also includes packing stations if and insofar as the ordered goods are suitable for delivery to a packing station.

4.2 The shipping costs and the type of delivery of the goods will be displayed to you during the ordering process in the online store.

§ 5 Terms of payment

5.1 The price is due upon conclusion of the contract, unless a later date is specified in the following terms of payment.

5.2 In the event of late payment, we reserve the right to charge you a fee of EUR 1.50 per reminder for the second and each subsequent reminder. You have the right to prove that we have incurred no or less damage. Further claims remain unaffected by this.

5.3 You can choose between the following payment methods in our online store:

5.3.1 PayPal
In order to be able to pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, legitimize yourself with your access data and confirm the payment instruction. The payment transaction will be carried out by PayPal immediately after the order has been placed. You will find further information in our order process. PayPal can offer registered customers and customers selected according to their own criteria further payment methods in the customer account. However, we have no influence on the offering of these modalities; such further individually offered payment modalities affect your legal relationship with PayPal. You can find further information on this in your PayPal account.

5.3.2 Klarna - via the payment service provider Mollie
Through the payment service provider Mollie B.V., Keizersgracht 126, 1015CW Amsterdam, The Netherlands (hereinafter referred to as "Mollie"), we offer the option of paying with Klarna as follows: Klarna Invoice and Klarna Sofortüberweisung. Mollie may use other payment services to process payments, for which special payment terms may apply, to which you may be informed separately. 5.3.3 Credit card and bank transfer - via the payment service provider Mollie
We offer you the option of paying for your order by credit card (Visa, Mastercard) and bank transfer via the payment service provider Mollie B.V., Keizersgracht 126, 1015CW Amsterdam, Netherlands (hereinafter referred to as "Mollie"). Mollie may use other payment services to process payments, which may be subject to special payment terms and conditions, to which you may be informed separately. § 6 Retention of title

The delivered goods shall remain our property until full payment has been made.

§ 7 Warranty

You are entitled to the statutory warranty rights.

§ 8 Liability

8.1 Any claims for damages on your part - for whatever legal reason - are excluded. This shall not apply in the event of fraudulent concealment of a defect, non-compliance with a guarantee of quality, injury to life, limb or health and/or in the event of an intentional or grossly negligent breach of duty on our part or in the event of a breach of obligations the fulfillment of which is the proper duty.breach of duty by us or in the event of a breach of duties whose fulfillment is essential for the proper execution of the contract and on whose compliance you may regularly rely (so-called essential contractual obligations / cardinal obligations). Claims under the Product Liability Act are also not affected by this limitation of liability. This limitation of liability applies equally to breaches of duty by our executive bodies and vicarious agents.

8.2 The claim for damages for the breach of essential contractual obligations is limited to the foreseeable damage typical for the contract, unless there is intent or gross negligence or we are liable for injury to life, limb or health.

8.3 The above limitations of liability apply equally to claims for reimbursement of futile expenses (§ 284 BGB). A change in the burden of proof to your disadvantage is not associated with the above provisions.

§ 9 Miscellaneous

9.1 German law shall apply. Mandatory consumer protection regulations from the country in which you have your place of residence remain unaffected.

9.2 Should individual clauses of these GTC be invalid in whole or in part, the remainder of the contract shall remain valid. If individual clauses are invalid, the content of the contract shall be governed by the statutory provisions.
